Terms of service

These Terms of Service govern your use of the Forrestdale Tools website and any purchase you make from us. By browsing this site or placing an order, you agree to these terms. Please read them before ordering.

1. About us

This website is operated by Forrestdale Tools (ABN 39 692 697 037), an Australian online supplier of cutting, machining and workshop tooling. References to “we”, “us” and “our” mean Forrestdale Tools. Contact: sales@forrestdaletools.com.au.

2. Eligibility

You must be at least 18 years of age and legally able to enter into a binding contract to order from us. By ordering you confirm that you are.

3. Orders

An order you place is an offer to buy. A confirmation email acknowledges receipt of your order but does not by itself create a contract. A contract is formed only when we dispatch the goods.

We may decline or cancel an order, in whole or in part, including where:

  • The goods are unavailable or have been discontinued
  • There has been a pricing or product description error
  • We are unable to verify payment or delivery details
  • We reasonably suspect fraudulent or unauthorised use

If we cancel an order you have already paid for, we will refund you in full.

4. Pricing and GST

All prices displayed on this website are in Australian dollars and exclude GST unless otherwise stated. GST is calculated and added at checkout, along with any delivery charges, so the total payable is shown to you before you confirm your order.

We may change prices at any time, but changes do not affect orders we have already accepted. Where a product is listed at a manifestly incorrect price, we may cancel the order and refund you rather than supply at that price.

Orders shipped outside Australia are GST-free but may attract import duties, taxes, customs charges or brokerage fees in the destination country. Unless otherwise stated in writing, these are the buyer’s responsibility and are not included in our prices or delivery charges. We are unable to advise the amount payable in the destination country.

5. Payment

Payment is required in full before dispatch, unless we have a written agreement with you for trade account terms. Where trade terms have been agreed in writing, payment is due in accordance with that agreement, and we reserve the right to suspend an account or withhold dispatch where an account is overdue.

We accept the payment methods shown at checkout. Payments are handled by third-party providers; we do not store your full card details. Title to the goods does not pass to you until payment has been received in full.

6. Availability, back-orders and special orders

Stock levels shown on the site are indicative and may change between your order and our processing of it. Where an item is unavailable we will contact you to arrange a back-order, a substitute, or a refund.

Special order items are goods sourced specifically for you and outside our core range. They may have extended lead times and are excluded from change-of-mind returns. Your rights under the Australian Consumer Law are unaffected.

7. Delivery, risk and title

Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by carriers, weather, peak periods or other circumstances beyond our reasonable control.

Risk in the goods passes to you on delivery to the address you provide. It is your responsibility to give a correct and complete delivery address; we are not responsible for goods delivered to an incorrect address supplied by you.

8. Returns and refunds

Returns and refunds are governed by our Refund Policy, which forms part of these terms.

9. Your rights under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

10. Product information, selection and safe use

We take care to describe our products accurately, but specifications, images and technical data are provided as a guide only and may be updated by manufacturers without notice. Images may be representative rather than of the exact item supplied.

Cutting tools and machine tooling are inherently dangerous if misused. You are responsible for:

  • Selecting a product suitable for your machine, material and application
  • Confirming compatibility of shank sizes, holders, speeds and feeds before use
  • Operating the product safely, with appropriate guarding and personal protective equipment
  • Complying with all applicable workplace health and safety requirements

Any technical guidance, speeds-and-feeds figures or application advice we provide is general in nature and offered in good faith. It is not a substitute for your own assessment. To the extent permitted by law, we are not liable for loss or damage arising from tool selection, machine setup, or use of our products.

11. Intellectual property

All content on this website — text, images, product descriptions, layout and logos — is owned by us or our suppliers and protected by copyright and trade mark law. You may view and print content for your own use in dealing with us. You may not reproduce, republish or use it commercially without our written permission.

12. Acceptable use

You agree not to use this website for any unlawful purpose, to interfere with its operation or security, to scrape or harvest data from it by automated means without our permission, or to attempt to gain unauthorised access to any part of it.

13. Limitation of liability

Subject to section 9 and to the extent permitted by law, our total liability arising out of or in connection with any product or these terms is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or refunding the price paid.

To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profits, loss of production, downtime, or damage to workpieces, machinery or tooling.

14. Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these terms or your unsafe or improper use of a product supplied by us, except to the extent caused by our own negligence or breach.

15. Privacy

We handle personal information in accordance with our Privacy Policy, which forms part of these terms.

16. Third-party links

Our website may link to third-party sites or manufacturer resources. We do not control them and are not responsible for their content, products or privacy practices.

17. Events beyond our control

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including supplier failure, carrier disruption, industrial action, natural disaster, or government action.

18. Changes to these terms

We may update these terms from time to time. The version published on this website at the time you place an order is the version that applies to that order.

19. Governing law

These terms are governed by the laws of Western Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia and any courts able to hear appeals from them.

20. General

If any provision of these terms is found to be unenforceable, the remaining provisions continue in force. Our failure to enforce a right is not a waiver of that right.
